Environmental Health Services Fees

The County Board of Supervisors approves the fees charged by Environmental Health Services (EHS). Fees are established to cover program costs for conducting inspections, responding to complaints, and ensuring programs comply with State laws that mandate monitoring and enforcement by EHS. 

On October 18, 2022, the County Board of Supervisors approved fee changes that will take effect July 1, 2023.

Tobacco Ordinance 

On April 25, 2023, the County Board of Supervisors will consider a tobacco ordinance, which if approved will increase the tobacco retailer annual permit fee from $174 to $423. The proposed fee increase has been calculated to cover the cost of administering an annual permit, complaint response, administrative hearings, and an annual inspection. Affected businesses were notified with 30-days-notice by email and mail.

  1. When will the fee changes go into effect?
    On October 18, 2022, the County Board of Supervisors approved fee changes that will take effect July 1, 2023 (FY 23-24). 
     
  2. Why did EHS propose fee changes?
    a. EHS is mandated to oversee various business practices governed by local and State statutes.
    b. EHS is self-funded through the fees we charge.
    c. EHS is not funded through tax money.
    d. Costs for EHS to perform services rise every year. EHS must change fees for cost recovery.
    e. Costs to provide public health and environmental safety services were reevaluated due to new legislative mandates that are continuously added.
     
  3. How will fees change?
    a. Some facilities will see an increase and others will see a decrease.
    b. Some fees will be moved to different fee categories or removed.

  4.  Where can I find fee changes that apply to me?
    a. Locate the “PE” fee category on your last invoice and reference the Environmental Health Services Fees PDF
    b. If you cannot find it, email ehsfees@smcgov.org.
     
  5. How did you determine how much you charge for each fee category?
    a. The fee reflects the average amount of time and resources needed to perform the service or oversight. 
     
  6. Are fines and penalty charges increasing also?
    a. No.
     
  7. How were businesses notified of the fee changes prior to approval?
    a. EHS updated this website, smchealth.org/ehfees.
    b. EHS notified various business associations.
    c. EHS sent multilingual emails and mailers to regulated businesses.
     
  8. Can I request a fee change delay?
    a. EHS cannot provide extensions to businesses to pay fees, but accepts multiple forms of payment, including credit cards. There are business resources that may be available to assist with business costs (see FAQ #10 below).
     
  9. Are there fee exemptions?
    a. The County’s policy on exemptions from annual fees is limited to: 
    • Businesses operated by blind persons.
    • Qualifying charitable organizations that distribute no compensation.
    • Farm labor and employee housing under specific conditions.
    • AB 498 provides for a veterans exemption statewide for any honorably discharged veteran who is a sole proprietor for any business selling or providing services (with some limitations).
  10.  Are there any business relief programs available?
    a. EHS does not offer payment plans.
    b. The Board approved a fee increase offset credit on October 18, 2022. Small businesses that quality for a credit will see a credit applied to their annual invoice in FY 23-24. Verification of eligibility is required. Businesses will be notified in Spring 2023 with more details.

Payment | Exemptions | Terms  

The following may be exempt from payment of annual fees:

  • Any business or activity operated by a blind person who has a certificate issued by the Bureau of Vocational Rehabilitation of the State of California.
  • Any business or activity owned and operated exclusively for charitable purposes where no person benefits through the distribution of profits or other compensation, as evidenced by volunteer staff and/or donation of all products or proceeds.
  • Farm and employee housing under specific conditions. 
  • AB 498 provides for a veterans exemption statewide for any honorably discharged veteran who is a sole proprietor for any business selling or providing services (with some limitations).
  • Fee exemption does not apply to fees associated with permit application fees, plan check fees, or reinspection fees.
